These Terms and Conditions ("Terms") constitute a legally binding agreement between you ("you" or "User") and DVNTND LLC, doing business as Aestra ("Company," "we," "us," or "our"), concerning your access to and use of the https://www.aestrabook.com website, the Aestra mobile application, and any related services (collectively, the "Services").
By accessing or using the Services, you agree that you have read, understood, and agree to be bound by these Terms. If you do not agree with these Terms, you must discontinue use of the Services immediately.
We reserve the right to modify these Terms at any time. We will notify you of changes by updating the "Last updated" date above. Your continued use of the Services after any changes constitutes acceptance of the revised Terms.
Aestra is a beauty booking platform that connects clients with beauty professionals, including but not limited to makeup artists, hairstylists, nail technicians, and lash technicians. The Services include:
To use certain features of the Services, you must create an account. You may register using your phone number via one-time password (OTP) verification or email and password. You agree to provide accurate, current, and complete information during registration and to keep your account information updated.
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized access to or use of your account. We are not liable for any loss or damage arising from your failure to protect your account.
Client Accounts: Clients may create accounts to book services with beauty professionals listed on the platform.
Artist Accounts: Beauty professionals ("Artists") may create accounts to list their services, manage bookings, set availability, and receive payments through the platform.
Clients may book services through an Artist's booking page by selecting services, choosing an available time slot, providing contact information, and completing any required intake forms. By confirming a booking, you agree to the selected service, date, time, and applicable fees.
Aestra acts solely as a platform to facilitate connections between Clients and Artists. We are not a party to any agreement between a Client and an Artist. Artists are independent service providers, not employees, agents, or contractors of Aestra. We do not guarantee the quality, safety, or legality of services offered by Artists.
Cancellation and rescheduling policies are set by individual Artists and will be communicated during the booking process. You agree to review and comply with the applicable Artist's cancellation policy before confirming a booking.
All payment transactions are processed through Stripe, a third-party payment processor. By making a payment through the Services, you agree to Stripe's Terms of Service and Privacy Policy. We do not store your full payment card details on our servers.
Artists may require a deposit at the time of booking. Deposit amounts and refund policies are set by individual Artists. Deposits are collected through Stripe and may be applied toward the total service cost.
Artists receive payouts for completed services through Stripe Connect. By using the Services as an Artist, you agree to create and maintain a Stripe Connect account and comply with Stripe's terms for connected accounts. Payout schedules and processing times are subject to Stripe's policies.
We may charge service fees or platform fees in connection with bookings. Any applicable fees will be disclosed to you before you complete a transaction.

The Services, including all content, features, and functionality (including but not limited to the Aestra name, logo, design, text, graphics, and software), are owned by DVNTND LLC and are protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works of any part of the Services without our prior written consent.
You retain ownership of content you upload to the Services (such as profile photos, portfolio images, and service descriptions). By uploading content, you grant us a non-exclusive, worldwide, royalty-free license to use, display, and distribute such content solely in connection with operating and providing the Services.
You represent and warrant that you own or have the necessary rights to any content you upload, and that such content does not infringe the rights of any third party.

THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that:
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, DVNTND LLC, ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SERVICES.
OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICES SHALL NOT EXCEED THE AMOUNT YOU HAVE PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER.
You agree to indemnify, defend, and hold harmless DVNTND LLC and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or related to:
We may suspend or terminate your account and access to the Services at our sole discretion, without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties, or for any other reason.
You may terminate your account at any time by contacting us at team@aestrabook.com. Upon termination, your right to use the Services will immediately cease. Any outstanding bookings or payment obligations will survive termination.
These Terms shall be governed by and construed in accordance with the laws of the State of Illinois, without regard to its conflict of law principles.
Any dispute arising out of or relating to these Terms or the Services shall first be attempted to be resolved through good-faith negotiation. If the dispute cannot be resolved through negotiation within thirty (30) days, either party may pursue resolution through binding arbitration in Cook County, Illinois, administered in accordance with the rules of the American Arbitration Association.
You agree that any dispute resolution proceedings will be conducted on an individual basis and not in a class, consolidated, or representative action.

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.
These Terms, together with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and DVNTND LLC regarding your use of the Services and supersede all prior agreements and understandings.
